*Please note: By April 2025, the South Carolina Department of Environmental Services (SCDES) will require developers and builders (Permittees) to submit construction Notice of Intent (NOIs) and associated documents through the SCDES online ePermitting system. To prepare for this change, Lexington County requests that you create an ePermitting account now and mail a signed Certifier Agreement (with an original wet signature) to SCDES. If the project engineer will be uploading documents, they must also create an ePermitting account. However, please be aware that the Permittee will be responsible for finalizing any submission in ePermitting; the engineer cannot submit on the Permittee's behalf. Completing these steps (creating an ePermitting account and mailing the signed Certifier Agreement) now will help avoid delays in reviews and approvals once the ePermitting system is implemented.

Once this process is in place, Lexington County will only provide the "Permit Letter" to be submitted with the NOI however, will continue to assist with reviewing the actual NOI.

After receiving approval from SCDES, the Permittee must request that Lexington County release the Land Disturbance Permit and Construction Permit in order to proceed.

The Lexington County Land Development Division is responsible for management of the County’s National Pollutant Discharge Elimination System (NPDES) Municipal Separate Storm Sewer System (MS4) Permit.   The Land Development division oversees construction site compliance, floodplain management and water quality programs.  The Division also oversees the implementation of air quality programs and initiatives.

The Lexington County Land Development Division has released the 2023 Floodplain Management Plan Progress Report outlining the progress made in mitigating the potential flooding hazards throughout the county.  The report lists 19 action items identified by county officials and residents that were published in the 2023 Floodplain Management Plan as important steps in addressing how the County will prepare for future potential flooding events, like the one experienced in October 2015.
